Final Disposition at Trial – October 6, 2020

Accused: Stephen Garvey of Calgary, Alberta.
Facts: On June 4, 2019, two charges under the Canada Elections Act, and two charges under the Criminal Code, were sworn in the Provincial Court of Alberta in Calgary. The charges resulted from an investigation into events surrounding the 42nd federal general election in 2015 and the confirmation of memberships for the Democratic Advancement Party of Canada in 2017.
Offence:

Under the Canada Elections Act, Stephen Garvey was charged with:

  • circumventing the contribution limit of $5,000 for contributions that a candidate was legally allowed to make to his or her electoral campaign; and
  • knowingly providing the Chief Electoral Officer with false or misleading documents.

Under the Criminal Code, he was charged with:

  • causing or attempting to cause the Chief Electoral Officer to use, deal with or act upon a document as if it were genuine, knowing or believing that it was forged; and
  • providing the Chief Electoral Officer with information, knowing it to be false or misleading.
Plea: On October 6, 2020, Stephen Garvey pleaded guilty to the charges under the Canada Elections Act. The charges under the Criminal Code were withdrawn.
Sentence: Stephen Garvey was sentenced to pay a $1000 fine for the charge related to circumventing the contribution limit and a $10,000 fine for the charge related to providing the Chief Electoral Officer with false or misleading documents, contrary to the Canada Elections Act. These fines are payable by October 30, 2020.
