Charges – June 4, 2019

Charge no. 1

That Stephen Garvey, a candidate for the Democratic Advancement Party of Canada, between August 2, 2015 and October 19, 2015, at or near the City of Calgary, in the Province of Alberta, did circumvent the statutory contribution limit of $5,000 set out in paragraph 367(7)(a) of the Canada Elections Act , S.C. 2000, c. 9, as amended, by paying for expenses in relation to his own electoral campaign for the 42nd federal general election, the total value of goods and services thus paid out of his own funds exceeding this contribution limit, contrary to paragraph 368(1)(a) of the said Act, thereby committing an offence contrary to paragraph 497(1)(e) of that Act.

Charge no. 2

That Stephen Garvey did, between February 1, 2017 and March 15, 2017, at or near the City of Calgary, in the Province of Alberta, make false documents with intent that they be used or acted upon as genuine, to the prejudice of the Chief Electoral Officer, contrary to paragraph 366(1)(a) of the Criminal Code.

Charge no. 3

That Stephen Garvey did, between February 1, 2017 and March 15, 2017 at or near the City of Calgary, in the Province of Alberta, knowing or believing that a document was forged, cause or attempt to cause the Chief Electoral Officer to use, deal with or act upon it as if it were genuine, contrary to paragraph 368(1)(b) of the Criminal Code.

Charge no. 4

That Stephen Garvey did, between February 1, 2017 and March 15, 2017, at or near the City of Calgary, in the Province of Alberta, contravene subsection 408(2) of the Canada Elections Act, S.C. 2000, c. 9, as amended, by providing the Chief Electoral Officer with information required under section 407 of the said Act, knowing it to be false or misleading, and did thereby commit an offence contrary to paragraph 497.1(3)(e) of the Act.
