As the official agent for the electoral campaign of Marcela Ramirez, an independent candidate during the 43rd general election held on October 21, 2019, Guillermo Ramirez was required, under subsection 477.59(7) of the Act, to file the Candidate's Electoral Campaign Return (Return) within four months after polling day. The deadline to submit the Return was February 21, 2020. Elections Canada confirmed that the Return was submitted to the Chief Electoral Officer on January 22, 2021, 336 days after the deadline.

There are therefore reasonable grounds to believe that Guillermo Ramirez was in violation of the requirement to provide the Return within four months of polling day, as required by subsection 477.59(7).
