As the financial agent for Paolo Villa, a Liberal Party of Canada contestant in the electoral district of Lanark–Frontenac–Kingston, during the 2019 nomination contest, Elaine Barnes was required, by virtue of subsection 476.75(7) of the Act, to file the Nomination Contestant's Campaign Return (Return), within four months after the selection date. The deadline to submit the Return was October 15, 2019.
Elections Canada has confirmed that the Return was submitted to the Chief Electoral Officer on February 9, 2021, 483 days after the deadline. There are therefore reasonable grounds to believe that Elaine Barnes failed to provide the Return within four months after the selection date, as required by subsection 476.75(7).
