Key facts of violation

As the official agent for Damien Roy, a candidate for the Rhinoceros Party of Canada in the electoral district of Mégantic–L'Érable during the 43rd federal general election held on October 21, 2019, Roger Arsenault was required, by virtue of subsection 477.59(7) of the Act, to provide the Candidate’s Electoral Campaign Return (Return) and other required documents within four months after polling day. The deadline to submit the Return was February 21, 2020.

Elections Canada has confirmed that the Return was submitted to the Chief Electoral Officer on April 20, 2021, 423 days after the deadline.

There are therefore reasonable grounds to believe that Roger Arsenault failed to provide the Return and required documents within four months of polling day, as required by subsection 477.59(7).
