Key facts of violation

As the financial agent for Patrick Weiler, a Liberal Party of Canada contestant in the electoral district of West Vancouver–Sunshine Coast–Sea to Sky Country during the 2019 nomination campaign, Berkley McNamara was required, by virtue of subsection 476.75(7) of the Act, to file the Nomination Contestant's Campaign Return (Return), and provide the required documents within four months after the selection date. The deadline to submit the Return was February 21, 2020.

Elections Canada has confirmed that the Return was submitted to the Chief Electoral Officer on May 12, 2021, 445 days after the deadline.

There are therefore reasonable grounds to believe that Berkley McNamara failed to provide the Return within four months after the selection date, as required by subsection 476.75(7).
