Key facts of violation

As the official agent for Mirwais Nasiri, a People’s Party of Canada candidate in the electoral district of Winnipeg South during the 43rd federal general election held on October 21, 2019, Rohit Thanki was required, by virtue of subsection 477.59(7) of the Act, to provide the Candidate’s Electoral Campaign Return and other required documents (Return) to the Chief Electoral Officer (CEO), within four months after polling day.

The deadline to submit the Return was February 21, 2020. Elections Canada's records confirm that it was provided to the CEO on May 18, 2021, 453 days after the deadline.

There are therefore reasonable grounds to believe that Rohit Thanki failed to provide the Return within four months of polling day, as required by subsection 477.59(7).
