Key facts of violation

As the financial agent for the People’s Party of Canada Argenteuil–La Petite-Nation Electoral District Association, William Wanklyn was required, under section 473 of the Canada Elections Act (the Act), to provide the Chief Electoral Officer with the Registered Association Financial Transaction Return and other required documents (Return) for the 2019, 2020, and 2021 fiscal years within six months of the deregistration. As the People’s Party of Canada Argenteuil–La Petite-Nation Electoral District Association was deregistered on March 31, 2021, the deadline to submit the Returns was September 30, 2021.

As of July 28, 2023, Elections Canada records indicate that the three Returns are still outstanding.

There are therefore reasonable grounds to believe that William Wanklyn failed to file the Returns, in contravention of section 473 of the Act.

Two aggravating factors were added to the AMP’s baseline amount. The first aggravating factor relates to the degree of intention or negligence. An investigator from the Office of the Commissioner of Canada Elections spoke with William Wanklyn on three occasions to inform him that Elections Canada had not received the Returns for the deregistered Association, as required by section 473 of the Act. William Wanklyn indicated to the investigator that he had no intention of providing the required documents, demonstrating a clear degree of intention, which is an aggravating factor under paragraph 508.6(1)(a) of the Act.

The second aggravating factor was added as William Wanklyn has a history of non-compliance for a violation of a similar nature under the Act, as he was issued a Notice of Violation on August 24, 2022, for a violation of subsection 477.59(7) of the Act.
