Key facts of violation
As the candidate for the People’s Party of Canada in the electoral district of Burnaby South during the by-election of February 25, 2019, Laura-Lynn Thompson was required, by virtue of section 477.42 of the Canada Elections Act (the Act), to appoint a replacement official agent without delay, upon being notified that her official agent was incapable of fulfilling his official agent duties.
On July 7, 2021, an investigator from the Office of the Commissioner of Canada Elections spoke with the candidate to inform her that her official agent found it difficult and confusing to complete his duties, given his advanced age. Consequently, given the official agent’s incapacity to fulfill his duties, the investigator recommended she appoint a replacement official agent. Elections Canada’s records confirm that, as of May 17, 2023, a replacement official agent had not been appointed.
There are therefore reasonable grounds to believe that Laura-Lynn Thompson failed to appoint a replacement official agent, as required by section 477.42 of the Act.
